National Trust Worker Earns Hard Fought Victory

 
 
 

WE Solicitors have been representing a former National Trust employee who has contracted mesothelioma. This is an incurable form of cancer caused through exposure to asbestos fibres in this case some 30 years before he developed any symptoms.

Despite providing witness evidence of his exposure whilst working on National Trust properties in the South West of England involving him taking down and smashing asbestos roof tiles with no breathing apparatus, the National Trust Solicitors decided to fight the case.

The case centred around whether or not the materials which he was asked to remove where in fact asbestos. After a number of court hearings and appeals the defendants agreed to pay the client a significant six figure sum to compensate him and his family for the injury and loss they have caused him to suffer.

The matter was unusual in that mesothelioma cases against the National Trust are infrequent. However asbestos was widely used in building materials throughout the 20th Century so it cannot come as any surprise that the buildings which they own and run will often contain asbestos building materials. As with any other employer the National Trust are under a duty to ensure that their employees have suitable personal protective equipment when dealing hazardous materials such as asbestos. The health risks associated to asbestos have been known since the 1930s and 1940s so there is little scope for large employers and public bodies to argue that they didn’t know asbestos was dangerous.

David Wingate the partner running the case said, “This is a fantastic outcome for our client and his family. Despite being diagnosed with a terminal cancer he has had to fight at every step against a large public body with significant resources to get to this point. Hopefully he can now have some peace of mind that the compensation he has recovered will afford his wife and family some degree of security”.
