Compensation of Almost £200,000 to Provide Financial Security for Family of Former Lagger who Died of Mesothelioma.

WE Solicitors settled the case of a former lagger who sadly died of mesothelioma, an incurable cancer caused through the inhalation of asbestos fibres.

We Solicitors were asked to go and see the sufferer just before he passed away and we were able to obtain a witness statement from him in his lifetime.  It turned out that he had been exposed to asbestos whilst working at a number of companies including:

  • Joseph Nadins Ltd
  • William Kenyons Ltd
  • Kitsons Insulations Ltd
  • Darlington Insulations Ltd

The law for mesothelioma sufferers has been simplified following the 2006 Compensation Act.  It meant that victims only have to prove exposure to asbestos and breach of duty or negligence against one of the defendants to recover all the damages in full.  It was felt to be too onerous and impossible to have to prove which asbestos fibres came from which employer in order to seek compensation.

The sufferer sadly passed away and the family took up the case.  It was necessary to go and see former colleagues and obtain witness statement from them confirming the conditions in which he had worked.

After long negotiations the family finally received the justice they deserved with nearly £200,000 of damages.  Whilst no amount of compensation could ever bring back a lost loved one our client would be satisfied to know that his wife and family are financially secure.
