The long awaited Government Mesothelioma Scheme for Untraced Insurers has finally been announced and will take affect from 1st July 2014. Details have been announced on the website of Gallagher Bassett who are the claims handlers dealing with the scheme.
This coincides with our first confirmation of payment under the scheme to a client who was diagnosed in September 2013 and sadly passed away a short time later from this awful condition. Whilst every attempt was made to search for the companies our client worked for, before emigrating to Canada, all our searches came to nothing. This included writing to former directors, tracing old insurers brokers in the area, advertising in the locality for former workers etc.
The tariff is purely based on age and does not take into account the personal needs and characteristics of the individual or the dependents. The form was lengthy and required witness evidence to be attached, proof of diagnosis, employment history and proof that searches had been made to trace the company.
Whilst the insurance industry would have you believe that claiming under the scheme is straightforward and simple, the investigations and legal work needed complete the process needed some in dpeth knowledge of how these claims work.
Whilst the widow of the deceased has received some compensation the final figure once CRU deductions have been made make the recovery significantly less than we would have recovered via a normal civil claim had the insurers been traced.
