As reported by the association of personal Injury Lawyers a Labour MP has tabled an Early Day Motion calling for the point of exposure to asbestos to be the trigger point for employers’ liability policies in mesothelioma cases.

During questions to the Secretary of State for Justice this week, Labour MP Natascha Engel asked Jonathan Djanogly MP if he agrees.

The Civil Justice Minister ruled out any legislation in the near future but offered to meet Ms Engel on the subject.

In the EDM, Ms Engel also called for the ABI to “cease its unrelenting attack on the victims of asbestos”.

In its press response to the Court of Appeal ruling, APIL said that is needed now is for the Association of British Insurers to take a lead on this issue and ask its members to play by the “old” rules until there is any hearing at the Supreme Court.  This request will now be taken up directly with the ABI.
