Mesothelioma claims will now remain protected from ATE and success fee deductions until the autumn, officials at the Ministry of Justice have confirmed.

The expected removal of the exemption from the effects of the LASPO Act currently in place for mesothelioma claims was expected to be implemented in July, but was delayed due to ‘technical reasons’.

During justice questions this week, justice minister Shailesh Vara MP, denied there was a secret deal with the insurance industry about mesothelioma claims, in response to a question from Labour MP Andy McDonald. The Government was also accused of “doing a rotten deal with Tory funders in the City to the detriment of dying people” by Stephen Hepburn MP. Mr Vara responded by telling Mr Hepburn that he should deal “with facts rather than supposition”
