WE Solicitors have successfully recovered substantial damages for a client who was sadly diagnosed with mesothelioma in January 2021.

Our client worked for Foremost Scaffolding Ltd based in London and subcontracted on various projects including the building of New Covent Garden in the mid 1970’s.

He recalls having to erect scaffolding towers for contractors so they could spray asbestos insulation onto the steelwork and roof space whilst he was working below them.  Asbestos was widely used to insulate and fire proof buildings throughout the 1960’s and 1970’s.

He remembers the dust being everywhere and he would be breathing in the fibres throughout his working day.  A colleague on the site advised him that it was asbestos that was being sprayed and told him it was “dangerous stuff”.

Our client who returned to live in Ireland some years ago, was diagnosed in January 2021 after becoming ill in the winter of 20120/2021 with pneumonia.  Routine tests showed he had mesothelioma, an incurable cancer caused through the inhalation of asbestos fibres.

When exposed to asbestos, symptoms only start to show decades later, in this case some 40 years.  The Health and Safety Executive estimate that about 5,000 people in the UK die every year from cancers caused by asbestos

Despite the company having dissolved many years ago, we were able to locate insurers to deal with the claim and the case was settled to ensure our client has the benefit of the compensation and financial peace of mind in his lifetime.

Steven Evans who dealt with the case said “It is extremely sad when I am contacted by families affected by mesothelioma as most asbestos related deaths could have been prevented with adequate protection of employees.  From the 1930’s it was widely accepted that asbestos was dangerous and certainly from 1965, most companies were on notice that even small amounts of asbestos could cause mesothelioma.

Whilst no amount of money can compensate a victim or family for the pain and suffering they have to endure due to irresponsible working practices decades ago, those responsible for exposing workers to asbestos, as in this case, will be held accountable.” If you or a loved one have been diagnosed with an asbestos illness please contact us today on 0800 294 3065 so we can advise how we can support and assist you through the claims process.
